Contest Rules

The San Diego Convention Center Corporation (SDCCC) occasionally conducts public contests via its social media handles. Unless otherwise stated, these Contest Rules cover all SDCCC social media contests. SDCCC contests are in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, Twitter or other social media platforms.

ELIGIBILITY:  No purchase or payment of any consideration is necessary to enter. All entrants and winners must be at least 18 years of age unless otherwise stated or posted. Contests are null and void in any jurisdiction where prohibited by law. All federal, state and local laws apply.

ENTRY: Entrants must send entries as required in the contest announcement to be eligible. Entries received after the deadline stated in the contest announcement are ineligible, null and void. All entry dates are based on Pacific Time (PT) unless otherwise noted. SDCCC will not be responsible for and will not consider incomplete or incorrect entries. SDCCC is not responsible for entries that are sent but not received by SDCCC for any reason. If specified, entrants may need to follow the SDCCC social media account used to enter the contest. Multiple entries are allowed, except where otherwise stated.

NOTIFICATION: Winners will be notified by the form/method of contact they provided to SDCCC when they entered the contest. If the winner does not respond to the notification within 48 hours, another winner will be chosen. Failure to respond within the time frame shall mean that the provisional winner forfeits the prize.

USE OF MATERIALS: All photos, drawings, text, and any other content or information (“Materials”) submitted by you to SDCCC shall become the non-exclusive property of SDCCC. SDCCC may use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish, and otherwise make use of Materials in any and all media, without compensation to you of any kind.

By submitting Materials to SDCCC, you represent and warrant that the Materials do not infringe any copyright, trademark, property rights, rights of privacy or publicity of any person, or any other right of any third party and that you have the full and unrestricted right to transfer the Materials to SDCCC free and clear of any claims or encumbrances.

You acknowledge and agree that SDCCC shall have no obligation to post, display or otherwise make publicly available any Materials submitted by you. You acknowledge and agree that Materials submitted by you may be made available by SDCCC for viewing and commenting by the public. You acknowledge that comments you disagree with or are unhappy about may become associated with Materials you submit to SDCCC. By submitting Materials to SDCCC, you waive any privacy expectations that you may have with respect to the Materials.

You agree to hold SDCCC and its officers, directors, employees, agents, successors, and assigns harmless from and against—and hereby waive any right to pursue—any claims of any nature arising in connection with SDCCC’s use of the Materials submitted to SDCCC and used in any manner in SDCCC’s sole and absolute discretion.

PRIVACY POLICY:  Except as otherwise provided in these Contest Rules, your personal information is subject to SDCCC’s privacy policy which can be found at visitsandiego.com/privacy-policy.

SELECTION OF WINNERS: Winners will be chosen by SDCCC on the merits of each entry, in SDCCC’s sole and absolute discretion. Unless otherwise stated, entries will be evaluated based on originality, clarity of message and adherence to the topic. 

Each contest will state a deadline for entry and the date by which the winner(s) will be announced. A list of winner(s) may be obtained by sending a self-addressed, stamped (first-class postage) envelope to SDCCC, Attn: Communications Department, and requesting the list.

SDCCC employees, including its parents, subsidiaries, affiliated companies, and agents and the immediate family (defined as parents, spouse, children, siblings, grandparents) of employees are not eligible to win.

PRIZES: Prize descriptions will be posted with contest details. If the specified prize becomes unavailable for any reason, SDCCC in its sole and absolute discretion may substitute a prize of like or equal value. Winners may not request substitutions of prize winnings. All winners are solely responsible for any and all taxes and/or fees as well as any additional costs that may be incurred. If prizes are to be picked up by the winner at the San Diego Convention Center, they must be picked up during the designated window of time or they may be forfeited.

Neither SDCCC nor its officers, directors, employees, agents, successors, or assigns shall be liable for any warranty, costs, damage, injury, or any other claims incurred as a result of the usage of a prize by any winner. SDCCC is not liable for any loss arising out of or in connection with any contest promoted by SDCCC.

SDCCC reserves the right to condition the award of prizes upon the execution by the winner(s) of a publicity release. Notwithstanding this reserved right, entry is conclusively deemed to be permission by the entrant to use the entrant’s name (without compensation to the entrant) if the entrant is a winner to publicize the contest and otherwise, as determined by SDCCC, unless prohibited by law.

PERMISSIONS: Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns and likenesses for online posting, and/or any advertising and publicity without additional compensation. Winners may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.

LIMITATION OF LIABILITY: By entering, participants agree SDCCC and its employees, officers, directors, shareholders, agents, representatives, affiliates, subsidiaries, advertisers, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of SDCCC that may cause the contest to be disrupted or corrupted; (v) any injuries, losses or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest.

VIOLATION OF CONTEST RULES: SDCCC reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, or violates these contest rules or the Site Terms and Conditions.

RIGHT TO MODIFY, SUSPEND, OR CANCEL CONTEST: SDCCC reserves the right to modify, suspend, cancel, or terminate the contest in the event that non-authorized human intervention, a bug or virus, fraud, or other causes beyond your control impact or corrupt the security, fairness, proper conduct, or administration of the contest.

ACCEPTANCE AND AGREEMENT TO ALL OF THE CONTEST RULES: By entering a contest, you conclusively are deemed to have agreed to be bound by these Contest Rules as well as by any rules specific to such contest. SDCCC reserves the right in its sole and absolute discretion to alter any contest details or terms and these Contest Rules at any time, and the right to terminate a contest at any time without prior notice.
